Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Innovaite LLC, doing business as LodeFinder ("LodeFinder," "we," "us"), governing your use of the LodeFinder website, the point inspector, the scored dropped-claim feed, watchlists, and alert emails (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service.

Not legal, investment, or professional advice

The Service is an informational tool only. Nothing it produces — scores, alerts, verdicts, PLSS descriptions, or any checklist — is legal, investment, financial, tax, engineering, or other professional advice, and using it creates no adviser, broker, agent, or fiduciary relationship. A mining claim conveys mineral rights only: no surface structures, no right to exclude others, and no patent. Consult qualified professionals and confirm every fact with BLM before locating, buying, selling, leasing, or spending money on any claim.

1. Who we are

The Service is operated by Innovaite LLC, a limited liability company, doing business as LodeFinder. References to "LodeFinder" mean Innovaite LLC d/b/a LodeFinder.

2. The Service

LodeFinder aggregates and scores publicly available U.S. Bureau of Land Management (BLM) mining-claim and land-status records, plus related public USGS data, and sends optional email alerts. The point inspector and dataset statistics are free; the scored feed, saved watchlists, and daily drop-alert emails require a paid subscription.

3. Data accuracy and BLM as the authoritative source

All claim, withdrawal, agency, and overlay data originate from public BLM and USGS services and may be incomplete, delayed, generalized, or wrong. BLM's "closed" claims layer is a rolling window with no true closure-date field, and our scores are heuristics — not guarantees. BLM's MLRS and official case records are the sole authoritative source. You must independently verify every claim's status, location, acreage, and any withdrawal directly with BLM (and the relevant county recorder) before taking any action or spending any money. We do not warrant that ground shown as "dropped," "open," or otherwise available is in fact available to locate.

4. Accounts and access

Sign-in is passwordless: we email a one-time link to the address you provide. You are responsible for keeping access to that email account secure and for activity under your account. You must be at least 18 and able to form a binding contract to subscribe.

Because the Service's value is timely access to public data — not any particular result — fees are non-refundable for data-driven outcomes, including a claim that turns out unavailable, withdrawn, already restaked, missed by an alert, or otherwise not as scored. This does not limit any rights you may have under applicable consumer-protection law, and it does not prevent us from choosing to issue a refund in our discretion. 7. Acceptable use

Don't scrape, crawl, resell, sublicense, or redistribute the Service's data in bulk; don't overload or abuse the BLM/USGS upstream services through the Service; don't attempt to breach security, reverse the gate, or access another user's account; and don't use the Service for any unlawful purpose. We may suspend or terminate accounts that violate these Terms.

8. Intellectual property

The underlying BLM and USGS records are public and not owned by us. The LodeFinder name, brand, interface, scoring model, and compiled presentation are ours. We grant you a limited, revocable, non-transferable license to use the Service for your own claim research while your account is in good standing.

9. Third-party services

The Service relies on third parties (for example Cloudflare for hosting, Stripe for billing, our email delivery provider, and BLM/USGS data services). We are not responsible for their acts, outages, or data, and your use may be subject to their terms.

10. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any alert will be sent, delivered, or received.

11. Limitation of liability

To the maximum extent permitted by law, LodeFinder and Innovaite LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost opportunities, or amounts spent locating or acquiring any claim. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the three (3) months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Innovaite LLC and its members from claims and expenses arising out of your use of the Service or your violation of these Terms or applicable law.

13. Changes to these Terms

We may update these Terms; we will revise the "Last updated" date and, for material changes, provide reasonable notice. Continued use after a change takes effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of [GOVERNING STATE — TO BE SET BY OWNER], without regard to its conflict-of-laws rules, and the exclusive venue for disputes will be the state and federal courts located in that state.
